Agreement to Terms

By accessing or using HeroBlend ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

Description of Service

HeroBlend is an AI-powered mobile application that allows users to blend their selfies with character images to create unique artistic blends. The service uses advanced AI technology to generate these creative images.

Eligibility

You must be at least 13 years old to use HeroBlend. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

User Accounts

To use HeroBlend, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

Subscriptions and Payments

HeroBlend offers both free and paid subscription tiers:

• Free users receive 2 free generations per month
• Pro subscribers get unlimited generations and access to premium styles
• Subscriptions are processed through Apple App Store or Google Play Store
• Payments are handled by RevenueCat
• Subscriptions automatically renew unless cancelled
• Refunds are subject to Apple/Google store policies

Acceptable Use

You agree NOT to:

• Upload images that violate laws or rights of others
• Upload images containing nudity, violence, or illegal content
• Use the service to create harmful, offensive, or defamatory content
• Attempt to reverse engineer or hack the App
• Use the service for commercial purposes without permission
• Abuse, harass, or harm other users
• Upload images of minors without proper consent
• Use the service to impersonate others or create deepfakes

Content Ownership and License

Your Content:

• You retain ownership of images you upload
• You grant us a license to process your images for generation purposes
• You are responsible for ensuring you have rights to all uploaded content

Generated Content:

• You own the generated blend images created by the App
• You may use generated images for personal purposes
• Commercial use of generated images may require additional rights clearance

Intellectual Property

The App, including its design, code, AI models, and branding, is owned by HeroBlend and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without permission.

AI Generation Disclaimer

AI-generated results:

• Are created by algorithms and may not always meet expectations
• Quality can vary based on input images and selected styles
• Generation times may vary depending on server load
• We do not guarantee specific results or quality
• Failed generations may occur due to technical limitations

Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not responsible for content created by users
• We are not liable for service interruptions or data loss

Indemnification

You agree to indemnify and hold harmless HeroBlend from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of others
• Content you upload or generate

Service Modifications

We reserve the right to:

• Modify or discontinue features at any time
• Change subscription pricing with notice
• Update AI models and generation capabilities
• Perform maintenance that may temporarily interrupt service

Termination

You may delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination:

• Your access to the App will cease
• Your data may be deleted according to our Privacy Policy
• Active subscriptions may not be refunded (subject to store policies)

Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

Governing Law

These Terms are governed by the laws of your jurisdiction. Any disputes will be resolved in the appropriate courts of that jurisdiction.

Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of significant changes.
